HIRE FOR SELF DRIVE BOATS

1. The contract does not take effect until we have received and accepted a completed booking form and the full hire fee from the hirer whose minimum age must be 18.

2. The hirer must pay a cash security of £50.00 which is returnable at the end of the hire when the boat is returned in as hired condition.

3. The hirer agrees to:

                A.    Ensure the designated driver remains sober as defined by the road traffic acts.

                B.    Comply with the conditions of hire contained herein

                C.    Not permit unruly behaviour on board.

                D.    Not permit any person to occupy the roof of the boat at any time.

                E.    Keep within the speed limit of 4 mph, not create a breaking wash          

                F.    Pass moored boats, canoes and fisherman at tick over speed.

                G.    Pass to the right of oncoming boats slowly.

                H.   Keep to the main channel, not entering into flashes,

(We will charge you £50.00 to tow you off, you have been warned).

                I.     Not entering into any lock, this is strictly forbidden.

                J.     The safe mooring of the boat, tow path side only.

                K.    Operating the engine as shown, allowing the revs to drop before selecting reverse or forward gear.

                L.    Not tampering with the engine or weed hatch.

                M.   Not permit fishing from the boat.

                N.    Ensure the safety of all persons on board throughout the hire.

4. We shall not be responsible for any delays or restrictions to cruising arising from obstruction, damage or repairs to the navigation and associated structures, flooding, shortage of water, industrial action, shortage     or rationing of fuel or any other cause beyond our control, we reserve the right to restrict the movement of  boats in the event of hazardous  conditions.

5. The boat shall be returned at the agreed time in a clean and tidy condition.  Late

returns will be charged at £30.00 per hour or part thereof.  Unreasonably dirty boats will forfeit all or part of the deposit.

6. UNSUITABLE HIRERS.  We reserve the right to decline a booking or refuse to hand over a boat if any person or group of people who in our opinion we deem not suitable or fit to take the boat.  In such cases any money received will be refunded in full and the contract will be discharged without further liability to either party. We only accept bookings from responsible adults. Positively No booze cruisers.

7. We reserve the right to repossess the boat at any time where an accident has occurred or is likely to occur because of the unsuitability of the hirer, or when the boat has more than the permitted maximum on board (12), or if the hirer is causing a nuisance to the general public and or other canal users, in such cases we shall not be liable to make any refund of part of the hire charge or deposit paid.

8. Injury or damage.  We will not be liable for death, personal injury, or loss or damage to your property or that of any passenger unless it is caused by our proven negligence.

9. No minor may control the boat without adult supervision.

10. In the event of an accident it is the hirer's responsibility to inform the company immediately and to take the names and addresses of those involved together with any witnesses

CONDITIONS OF HIRE FOR MERLIN

1. A booking is confirmed only upon the return of a booking form signed by the hirer and the receipt of a £100 deposit.  The Company will then return written confirmation of that booking.  Whilst every endeavour is made to satisfy all clients requirements, confirmation is on a first come, first served basis.

2. The outstanding balance will become due on or before the commencement of the cruise.

3. The company can only accept payments in cash or by cheque.  Due to high administration charges we, regrettably, do not accept credit or debit cards.

4. Cancellation of a booking is acceptable up to 14 days before the date of hire, however, £50 will be retained for administration costs.  Should the booking be cancelled within 14 days of the date of hire the company will retain the full £100 deposit.

5. For catered cruises on Merlin, confirmation of passenger numbers must be received by the company at least 4 days before the date of hire.  The minimum charge is for 20 persons.  The maximum, for comfort, when seated is 35 persons.  Should a member of the party fail to arrive, after final numbers have been confirmed, the full applying fare will still be liable.

6. The company reserve the right to cancel or alter the route or embarkation point of any booking for any reason such as breakdown or canal closure.  In the event of such cancellation, the company will endeavour to offer alternative dates.

7. The company will not be liable for any loss or damage to any article belonging to, or injury to any passenger sustained during the hire period, however caused.

8. Breakage's or damage to the company's property by a passenger may result in a charge being levied to remedy such loss.

9. Smoking is not permitted within the cabins on Merlin or Mayfly, but is permitted on the foredeck of Merlin and fore and aft decks of Mayfly.

10. Safety and civil conduct on board are a matter of common sense.  The company may require the hirer to assist in dealing with any passenger whose conduct is deemed uncivil or unsafe.  The company reserve the right to terminate a cruise if, in the opinion of the boat master, the safety of the passengers, crew or boat becomes compromised.
